DEFINITION AND OBJECT OF THE CONTRACT

This agreement ("Agreement") is a distance contract pursuant to Art. 50 and ss. Legislative Decree no. September 6, 2005, n. 206 ("Consumer Code"). The Contract for the sale of goods between PLATANO LUCIANO and the consumer (the "Customer"). The contract between PLATANO LUCIANO and the Client shall be concluded with the acceptance, even partial, by PLATANO LUCIANO. This acceptance is automatic, unless otherwise communicated to the client. By placing an order in the manner provided, you acknowledge that you have read all the information provided to him during the purchase process, and accept the general conditions and payment transcribed below.

PRICES

The selling prices of the products shown on the website are inclusive of VAT and all other taxes. Transport costs are not included.

METHODS OF PAYMENT

The customer will be allowed to choose one of the following methods of payment:

Cash: Cash on delivery costs an additional € 8.00 for collection charges money. Nothing more than what is stated in the order shall be payable by the customer.
For the total amounts superioria 999,00 Euro (as required by Italian law) the payment must be done by means of a bank check.
Bank Transfer: In case of payment by bank transfer in advance, as ordered by the customer will be kept busy until cleared by the bank credited the amount due on a / c of PLATANO LUCIANO. This credit must be made within 7 working days from the date of acceptance. Processing time depends on the speed of the order of the bank's credit and hovering average about 3/4 working days.

DELIVERY OF PRODUCTS

PLATANO LUCIANO delives the products to the address specified by the customer. Any complaint will be forwarded to the following address: PLATANO LUCIANO – Viale Verona 99-101 - 37022 Fumane - (VR).
The delivery made by the courier selected (Bartolini) is made exclusively to the road surface.

WARRANTY AND SUPPORT

All products sold by PLATANO LUCIANO are covered by the manufacturer's standard warranty and 24-month warranty for defects, pursuant to Legislative Decree 24/02. To qualify for the warranty, the customer will keep the invoice / receipt (or DDT).

The guarantee of 24 months in accordance with the Decree 24/02 applies to products that present a lack of conformity, provided that the product is used correctly, in accordance with its intended use and as provided in the attached technical documentation.

This guarantee is for private consumption (a person who buys goods for purposes not related to his professional activity, or making a purchase order form without indicating a VAT number).

In case of lack of conformity, PLATANO LUCIANO provides, without cost to the customer, the restoration of conformity by repair / replacement or reduction of the price, until the termination of the contract.

No damage can be obtained from PLATANO LUCIANO for any delays in repairs or replacements. In cases where the application of safeguards providing for the return of the product, the product must be returned by the Customer in its original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc. ... ), to limit damage to the original package, we recommend, when possible, to put it in another box should be avoided in all cases the attachment of labels or tape directly on the original packaging of the product.

METHODS AND COSTS OF DELIVERY

Delivery costs for Italy are shown explicitly at the time of order. Nothing is due from the Customer with respect to the total order.

No responsibility can be attributed to PLATANO LUCIANO in case of delay in the order or delivery of the order.

Delivery is at street level. Upon delivery of the goods by the carrier, the customer is required to check:

• that the number of packages delivered corresponds to what is indicated in the transport document.

• that the packaging is not damaged, or wet or otherwise altered, including the sealing materials (adhesive tape or metal).

Any damage to the packaging and/or product or the mismatch in the number of items or information, should be immediately notified, BY WRITING ON THE DOCUMENT of delivery of the courier. Once signed the slip, the customer can not make any claim about the appearance of the goods.

Any problems concerning the physical, correspondence or completeness of the goods received must be reported within 7 days after delivery, as provided herein.

OBLIGATIONS OF THE CLIENT

The Customer represents and warrants as follows:

• to be a consumer in accordance with Art. 3 of the Consumer Code;

• to be adult (over 18 years);

• that the data supplied by the same for the execution of the Agreement are true and correct.

RIGHT OF WITHDRAWAL

Pursuant to art. 5 DL 185/1999, if the customer is a consumer, have the right to withdraw from the purchase contract for any reason, without explanation and without penalty.

To exercise this right, the customer must send to PLATANO LUCIANO a notice to that effect within 10 working days of receipt of the goods. Such notice shall be sent by registered letter with acknowledgment of receipt, addressed to:

or by telegram or fax sent within that period of 10 days and followed by a confirmation by registered letter with acknowledgment of receipt, sent out until 48 hours later. The customer's must send the goods to PLATANO LUCIANO by his expense within 10 days from authorization.

The goods must be returned intact, with all its parts and in its original packaging (bags and boxes), preserved and possibly used in the normal care, without any signs of wear or dirt.

The right of withdrawal is subject to the following conditions:

• The law applies to product purchased in its entirety, it can be exercised only on the withdrawal of the product purchased (eg: accessories, software, attachments, etc ...).

• The products must be returned intact and in original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc ...) to limit damage to the original package, we recommend, when possible, to enter into a second box should be avoided in all cases the attachment of labels or tape directly on the original packaging of the product.

• by law, the shipping costs for return of the goods shall be borne by the customer.

• the shipment until the certificate of receipt in our warehouse is under the responsibility of the customer.

• if the goods are damaged in transit, PLATANO LUCIANO will inform the customer (within 5 working days of receipt of the goods in their stores), to enable a timely complaint against the carrier of his choice and to obtain reimbursement of the value of the property (if insured), in this case the product will be made available to the customer for the return and canceling the request for withdrawal.

• PLATANO LUCIANO is not responsible in any way for damage or theft/loss of goods returned by uninsured shipments.

Without prejudice to any repair costs for damage to the original, PLATANO LUCIANO will refund the customer the full amount paid, less shipping costs incurred within 14 days of return of goods, by transfer of the amount charged to the credit card or by bank transfer. In the latter case, the Buyer shall promptly provide the bank details for the refund (code ABI - CAB - Account of the invoice).

The right of withdrawal is lost for lack of the essential integrity of the good (box and/or its contents), in cases where PLATANO LUCIANO finds:

• the lack of external and / or internal packaging.

• the absence of elements of the product (accessories, cables, manuals, parts, ...).

• damage to the product for reasons other than transportation.

In case of forfeiture of the right of withdrawal, PLATANO LUCIANO will return to sender the property purchased by charging the same shipping.

TREATMENT AND CONFIDENTIALITY OF PERSONAL DATA PURSUANT TO LEGISLATIVE DECREE. 196/03

The personal information requested under the order are collected and processed in order to meet the expressed requirements of the customer and will not under any circumstances or for any reason be passed to third parties. PLATANO LUCIANO guarantees its customers the respect of rules on the processing of personal data covered by the Privacy Code referred to in Legislative Decree 196 dated 30.06.03
The data holder is PLATANO LUCIANO.

JURISDICTION

The Agreement is governed by Italian law. Any dispute relating to the application, execution, interpretation and breach of contract will be the responsibility of the Court of Verona.
